Terms of Service
These terms are the agreement between you and the person who makes ate. They are short on purpose. By creating an account or using the app, you accept them.
1. What ate is
ate is a free Android app for keeping a personal, private collection of the dishes you eat. It photographs a plate, suggests what the dish is, and stores the result under your account along with anything you choose to add: a place, a date, a rating, a note.
ate is provided by Noko Labs as an independent project. It is not affiliated with, endorsed by, or sponsored by Google, Supabase, Cloudflare or any restaurant or brand whose food you photograph.
2. Your account
- You need a Google account to sign in. You are responsible for keeping access to it secure.
- You must be at least 13 years old, and old enough to agree to a contract where you live.
- One person, one account. Do not share your account.
- You can close your account at any time. See Delete your data.
3. Your content
Your photos, notes and ratings remain yours. You keep every right you had in them before you uploaded them.
You grant us a limited, worldwide, royalty-free licence to store, reproduce and process that content strictly so the app can work for you: making the sticker cut-out, sending one photo for recognition, syncing your collection between your devices, and backing it up. The licence exists only to run the service, covers nothing else, and ends when you delete the content or your account.
We will not publish your content, show it to other users, sell it, license it onward, or use it in marketing.
You confirm that for anything you upload:
- You took it, or you have the right to use it.
- It does not infringe anyone’s rights and is not unlawful, hateful, or sexual content involving minors.
- It does not contain other people’s personal data that you have no right to share.
4. Acceptable use
Please do not:
- Reverse-engineer, decompile or tamper with the app beyond what the law allows you to.
- Automate, scrape or bulk-submit requests, or otherwise abuse the recognition service.
- Attempt to reach another user’s data, or probe the service for vulnerabilities without telling us first.
- Use ate for anything illegal.
Found a security flaw? Report it to nokolabs.dev@gmail.com before disclosing it anywhere. We will not pursue anyone who reports responsibly.
5. AI recognition
Dish suggestions come from an AI model and are frequently wrong. They are suggestions, not facts. You always get the final say on what a dish is called.
ate tells you nothing about ingredients, allergens, calories or nutrition, and nothing in the app is dietary or medical advice. If you have an allergy or a medical condition, ask the kitchen, not an app.
By using recognition you accept that the photo you submit is sent to Google’s Gemini API on the terms set out in our Privacy Policy.
6. Our intellectual property
The ate name, the app, its interface, its illustrations, the dish artwork, the sets and this website belong to Noko Labs. Using the app does not transfer any of that to you. You may not copy the design or the artwork for your own product.
7. Availability and changes
ate is free and offered as-is. We may change features, pause the service for maintenance, or discontinue it entirely. If we ever shut it down, we will give reasonable notice and a way to export your collection first.
The app depends on services we do not control: Google Sign-In, the Gemini API, Maps, Supabase, Cloudflare. If one of them fails, parts of ate will fail with it.
8. No warranty
To the fullest extent the law allows, ate is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability, accuracy or non-infringement. We do not promise the service will be uninterrupted, error-free, or that recognition will be accurate.
9. Limitation of liability
To the fullest extent the law allows, Noko Labs is not liable for indirect, incidental, special or consequential damages, nor for lost data, lost profits or lost memories arising from your use of ate. Because the service is free, total liability for any claim is limited to £100.
Nothing here excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded. If you are a consumer, your statutory rights are unaffected.
Please keep your own backup of photos that matter to you. ate is a collection, not an archive of record.
10. Ending this agreement
You may stop using ate and delete your account whenever you like. We may suspend or close an account that breaks these terms, or that puts the service or other users at risk, with notice where it is practical to give it.
11. Governing law
These terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer resident elsewhere, you keep the protection of the mandatory laws of your own country.
12. Changes to these terms
We may update these terms. The date at the top will change and, for material changes, the app will tell you. Continuing to use ate after that means you accept the new version.
